Privacy Policy & Farmer Data Sovereignty

LAST REVISED: OCTOBER 2026 · HOTEYE (PTY) LTD & HOTGROUP CC

CONSTITUTIONAL INVARIANT 4 · ABSOLUTE FARMER DATA SOVEREIGNTY

Your Farm. Your Animals. Your Sovereign Intellectual Property.

Unlike Silicon Valley AgTech platforms that aggregate farmer herd sizes, stocking rates, and pasture boundaries to sell speculative intelligence to grain commodity traders or hedge funds, HOTEYE (Pty) Ltd does not, and will never, monetize, sell, or disclose your farm’s operational data, GIS polygons, or animal bio-telemetry to third parties without your explicit, cryptographically signed authorization.

1. Responsible Party & Legal Entity

This Privacy Policy governs the processing of personal and operational information by HOTEYE (Pty) Ltd (Registration No: 2024/000000/07), having operational headquarters in Pretoria and field operations in Bothaville, Free State, in licensing partnership with HOTGROUP CC (Est. 1987).

Information Officer Contact: [email protected] | Tel: +27 (0) 12 000 0000.

2. Categories of Information Processed

  • Farmer & Operator Contact Data: Full name, farm enterprise name, mobile/WhatsApp telephone numbers, email address, physical postal address, and agricultural co-op account identifiers.
  • Spatial & Cadastral Data: 21-digit Surveyor-General (SG-21) parcel codes, farm boundary polygons, internal paddock/camp lines, and borehole/dam coordinates.
  • Telemetry & Biological Data: WGS84 GPS latitude/longitude, elevation, speed, heading, collar strap load-cell strain measurements, 6-axis IMU rumination/stampede classifications, thermopile temperature readings, and 512-D Bovine Rhinarium (nose-print) biometric vectors.
  • Control Room Forensics: Operator usernames, timestamped alarm acknowledgment logs, and tbldismissalarm forensic sign-off reasons pursuant to SAIDSA By-Law 25 evidentiary standards.

3. Lawful Basis for Processing

Processing is conducted in strict compliance with Section 11 of the Protection of Personal Information Act (POPIA Act 4 of 2013):

  • Performance of Contract: To ingest, evaluate, and dispatch telemetry, geofence breaches, and animal health alarms across the HOTEYE 3D GIS platform.
  • Compliance with Legal & Statutory Obligations: Including SAIDSA By-Law 25 control room record-keeping and South African Police Service (SAPS) stock theft investigation evidentiary custody under Section 205 of the Criminal Procedure Act.
  • Legitimate Interests of the Data Subject: Securing rural livestock, infrastructure, and human life against criminal syndicates and acute biological disease outbreaks.

4. Third-Party Disclosures & Selective Integrations

Telemetry is disclosed to external institutional entities only upon your explicit, affirmative opt-in:

  • Commercial Banks: For Live Biological Collateralization lien auditing (e.g., Standard Bank, Absa, Land Bank) when applying for working capital credit.
  • Carbon Registries: For Verra VM0026 and Gold Standard Soil Carbon Sequestration verification, enabling audited farmer payout distributions.
  • Underwriters: For parametric livestock mortality insurance claim verification and premium rebates with your insurer of record.
  • Armed Response & Farm Watch: Real-time dispatch telemetry routed exclusively to your designated private security service provider or community Plaaswag.

5. Security Safeguards & Data Sovereignty

All HOTPROTO_V2 telemetry frames are transmitted over private Sub-1 GHz Wi-Fi HaLow RF or encrypted TLS sockets. Spatial features are stored in sovereign PostgreSQL 16 + PostGIS clusters protected by hardware firewalls, strict role-based access control, and SHA-256 tamper-evident cryptographic digests.

6. Your Statutory Rights as a Data Subject

Under POPIA Sections 23–25, you hold the right to request access to, correction of, or deletion of your personal data, or to lodge an objection with the South African Information Regulator:
